General Terms and Conditions
Attribute - a user’s account in one of the systems where information about the number of title units is recorded.
Claim Rights (hereinafter also abbreviated as “CR”) - rights of claim to a third party, a resident of Ukraine (hereinafter - “User”) by actual receivables denominated in the national currency of Ukraine or conventional units. Under this Contract Claim Rights are transferred (assigned) in accordance with Art. 512 and 656 of the Civil Code of Ukraine.
The term title units should be understood as the right to demand a certain amount of goods or services without any monetary settlements in the amount of established equivalent. Title units - the accounting units of CR visually displayed on the Attribute which the owner of this Attribute has. One title unit accounts for the unit of debt according to the established rate, which is the subject of the claim rights. Accounting is carried out in hundredths of Title units.
Electronic payment system (hereinafter - “EPS”) is a hardware and software complex that implements a settlement system using funds of electronic communication between users (holders of electronic accounts of this system).
The Website of the Service (hereinafter - the "Website") is located at http://cryptoexmoney.com
An Application means a set of data in electronic form received from the User using software and hardware of the Website tools containing sufficient information about the exchange transaction.
An exchange operation means the conversion of one type of title units of EPS to another type of title units of the same EPS or another.
The subject of this Agreement is the provision to the User the services of automatic exchange of title units represented on the EPS website, which are as follows:
the service transmits, and the user receives the following requirement, which is the subject of the assignment of the main debt without taking into account the interest rate;
the cost of assignment of the claim under this agreement is indicated on the home page of the Website without VAT;
the subject of this agreement is a transaction in accordance with paragraph 3 of Art. 656 of the Civil Code of Ukraine.
The Service has the right to amend this Agreement at any time without prior notice.
Rules for processing applications
The current list of areas of exchange operations, as well as exchange rates for title units are published on the Website in Exchange Rates section, which is located on the home page in the “our reserves” block.
Tariffs for exchange operations can be changed at any time without prior notification to users, without changing the conditions for the exchange of unfinished applications.
From the moment of receipt of the Application, the Service instantly confirms the possibility of its execution by sending an appropriate message to the User electronically (by e-mail) or via the Website interface.
After completing the Application, the User is given 20 minutes to make a payment. If this does not happen, the Application closes automatically.
If, from the moment of receipt of the Application, it is not possible to process the Application, the User receives an appropriate message in electronic form (via e-mail) or via the Website interface. If within 24 hours the Service does not find the opportunity to fulfill the Application, the application will be closed automatically. From the moment it becomes possible to execute the Application, the User receives an appropriate message in electronic form (by e-mail), after which the User must pay within 20 minutes, if this does not happen, the application closes automatically.
Upon receipt of title units to the account of the Service, the Service transfers within 5-120 minutes to the account of the User according to the Application . If for some reason this transfer cannot be completed, the operation is repeated unlimited number of times until the transfer is successfully completed.
An Application is considered to be completed from the moment of transferring the title units from the Service to the User to the electronic account specified in the Application.
Applications, their closure, as well as payment for them are accepted only through the interface of the Website and recorded by software and hardware Website Tools. The parties admit the moment of CR transfer as the moment of receipt of cost payment of the claim assignment by the service.
When returning funds, commission expenses are withheld from the funds received at the expense of the User.
The service has the right to refuse the provision of services to the User indicating the reason for the refusal in electronic form or without explanation.
Obligations of the parties
The service agrees that: gives the user a valid requirement; the assigned claim by the service is not assigned to anyone and will not be assigned in case of acceptance (acceptance of this offer) by the user.
The user agrees to pay the cost of assignment of the claim in accordance with the conditions of paragraph 2.1. within the time periods specified in paragraph 2.5. of this agreement.
At the moment of transferring the CR to the user, the service transfers the Title units to the User’s attribute in an amount equal to the value of the assigned CR.
Responsibility of the parties
The service is not responsible to the User for damage of any kind suffered by the User in connection with the loss, disclosure or theft (hacking) of his/her password by third parties, lack of access to the Website and / or inability to use the services of the Service.
The service is not responsible for the malfunctioning of communication channels that ensure the operation of the Service, as well as for malfunctions of its server and / or EPS servers. If in case of such a failure the transfer from the Service to the User or vice versa was not delivered, the Service undertakes without fail to resolve this issue over time, commensurate with the solution of a similar problem.
The service is not responsible for the incorrect or unlawful use of EDS by the User.
The user guarantees that he/she is the owner of the account to pay for the Application and has the right to manage the funds in this account.
When filling out the Application, the User confirms his/her acceptance of the exchange terms, including the amount of payment, taking into account the EDS commission (if any), the amount of receipt, taking into account the EDS commission (if any).
The user is fully responsible for the accuracy of the details specified in the Application.
The User guarantees compensation for losses in connection with the claims of third parties directly or indirectly related to the use of the Service by the User.
The claims of the User regarding the operation of the service are accepted by the Service for consideration by e-mail (or through the feedback form in the section "Contacts") and no later than 3 working days from the date of the problem when the User presents the relevant documents, confirming payment, as well as application data. The term for consideration of the User’s claim is 5 working days.
The Service has the right to involve authorized persons, EDS agents in the consideration of claims.
Agreement validity and dispute resolution
The agreement comes into force from the moment of acceptance (acceptance of the proposal) by the user and is terminated by the execution. The acceptance of the agreement is payment by the user of the value of the assignment of the claim in accordance with paragraph 2.1 of this agreement.
In legal relations not regulated by agreement, the parties are guided by the current legislation of Ukraine.
The service receives personal data from the User when filling out the Application and fixes it in the database.
The service has the right to request additional information about the user's personal data.
User’s personal data may be used by the Service solely for the purpose of ensuring the operation of the Service and may not be transferred to third parties, with the exception of cases established by law, the rules of the work of exchange office for a specific EDS and international law.
The Service relieves itself of responsibility for full or partial failure to fulfill obligations under these Rules due to force majeure circumstances, namely: natural disasters, war or military operations, damage or malfunction of communication lines, changes in legislation or other, not depending on the Service, extraordinary and inevitable circumstances that occurred against its will, and provided that these circumstances directly affected the operation of the Service.
